Scope and provider
These Terms and Conditions apply to membership of MinibarClub and the use of minibarclub.com. The provider is Philip P.M. Jansohn, Canettistrasse 1 / 1201, 1100 Vienna (“MinibarClub”, “we”). Separate partner terms apply to hotels.
What MinibarClub is
MinibarClub is a marketing and benefits platform for independent hotels. Participating hotels grant members advantages (“benefits”). MinibarClub is neither a travel agency nor a booking portal: we do not sell or broker hotel services. The accommodation contract is concluded exclusively between you and the hotel.
Membership
- Membership is free of charge. Adults of legal age may become members.
- Membership begins when you confirm your email address via the link sent to you.
- One account per person is permitted. Membership is personal and non-transferable.
- You must provide truthful information and protect your email address against access by third parties.
Benefits
- Benefits are granted exclusively by the respective hotel. Each hotel determines the type, scope and conditions itself; the description on the hotel page at the time you add your stay applies.
- Direct bookings only: benefits apply exclusively to stays booked directly with the hotel (e.g. on the hotel’s website, by phone or by email). Bookings via travel portals, travel agencies or other intermediaries are excluded.
- Guaranteed benefits are confirmed when you add the stay. Benefits subject to availability are subject to availability and only apply once confirmed by the hotel.
- Benefits apply to the stay added, cannot be redeemed for cash, are non-transferable and, unless the hotel states otherwise, cannot be combined with other promotions.
- A member discount refers to the current daily rate offered by the hotel on the day of booking for direct bookings.
- The hotel may decline benefits if the requirements are not met – in particular if the booking was not made directly or the details do not match.
Adding a stay
When adding a stay, you confirm that you booked it directly with the hotel and agree that we pass your details to the hotel. The Benefit Card serves as proof at check-in. The hotel may additionally request photo ID.
Member obligations and misuse
In particular, false information about bookings, adding stays not booked directly, passing the Benefit Card on to third parties and any automated or abusive use are prohibited. In the event of violations we may suspend or terminate the membership.
Availability and changes
We strive to keep the platform available without interruption but cannot guarantee this. The participating hotels and their benefits may change at any time. Benefits already confirmed for stays added remain unaffected.
Liability
The respective hotel is solely responsible for granting benefits and for its services. We are only liable for damage caused intentionally or through gross negligence; this does not apply to personal injury. Mandatory consumer rights remain unaffected.
Ending the membership
You can end your membership at any time without giving reasons by deleting your account in your profile. We may terminate the membership with one month’s notice by email; the right to suspend for good cause remains unaffected.
Changes to these terms
We may amend these terms with effect for the future. We will inform you of material changes by email at least four weeks in advance. If you do not object within this period, the changes are deemed accepted; we will point out this consequence separately in the notice. You may also end your membership at any time in this case.
Applicable law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence. For claims against consumers resident in Austria, the court at their place of residence has jurisdiction.
